Bergg — Terms of Service

These terms govern your use of the Bergg iOS app and the Bergg backend
service. By creating an account you agree to them. They are deliberately
short.
1. What Bergg does
Bergg transcribes voice recordings using OpenAI's Whisper service and
structures the resulting text into customer-ready documents using
Anthropic's Claude service. The output is a starting point for you to
review, edit, and send.
2. What Bergg is not
- Bergg is not a substitute for professional judgement. AI-generated outputs can be wrong. Always read what Bergg writes before sending it to a customer or filing it with a regulator.
- Bergg does not give legal, financial, or trade-regulatory advice. Compliance certificates produced by Bergg are summaries of what you told the app, not formal certifications.
- Bergg is not a merchant of record for any work you do. Invoices generated by Bergg are your invoices to your customers; payment, tax, and contractual liability are between you and them.
3. Your responsibilities
- Provide accurate information when you register.
- Keep your password and device secure. We hash your password but cannot prevent loss if you share it.
- Read every AI-generated document before sending it. You are responsible for the words that go out under your business name.
- Use Bergg only for documenting work you legitimately performed. Do not use Bergg to generate fraudulent invoices, fake compliance certificates, or to impersonate another business.
4. Subscriptions
- The Free tier is included with the app. Pro and Max are auto-renewing subscriptions billed by Apple.
- Subscriptions renew automatically at the end of each period until you cancel.
- You can manage and cancel any subscription in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period — you keep access until then.
- Refunds are handled by Apple per their refund policy. We do not have the ability to process refunds directly.
- Apple's pricing tiers determine the prices users see. We may change prices for new subscribers; existing subscribers are notified per Apple's rules.
5. Acceptable use
You agree not to:
- Use Bergg for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or extract source code from the app.
- Use Bergg to abuse the OpenAI or Anthropic AI services through us.
- Share your account with people outside your business.
- Submit content (in transcripts or documents) that infringes someone else's intellectual property or violates a law.
We may suspend or terminate accounts that violate these rules without
refund.
6. AI output ownership
Documents Bergg generates for you, based on your voice notes, belong to
you. You are free to use, edit, send, file, and republish them as your
own work product. We make no claim over the output.
The Bergg app itself, the AI prompts we use internally, and our backend
code remain our property.
7. Service availability
We aim to keep Bergg up and running but make no specific uptime
guarantee. The app depends on OpenAI's, Anthropic's, and Apple's services
— if any of those go down, Bergg's relevant features will too. When AI
services fail, Bergg falls back to saving your raw transcript so you
don't lose work.
8. Liability
Bergg is provided "as is" and "as available". To the maximum extent
allowed by law:
- We are not liable for indirect, incidental, or consequential damages arising from your use of the app.
- Our total liability for any direct damages is capped at the amount you paid us in the 12 months preceding the claim. For Free-tier users that's $0; for paying users it's capped at the subscription fees you paid.
9. Termination
You can terminate your account any time in Settings → Delete Account.
We may terminate your account if you breach these terms, with reasonable
notice except for egregious violations (fraud, illegal content) where
we may act immediately.
10. Changes
If we change anything material we will update the "Last updated" date
at the top of this page and, for breaking changes, prompt you to
re-accept on next login.
11. Governing law
These terms are governed by the laws of Uzbekistan. Any dispute that
cannot be resolved by good-faith conversation will be settled in the
courts of Tashkent.
